These Terms of Use (“Terms”) govern your access to and use of the CoachYou360 LLC website, digital products, applications, assessments, programs, courses, workshops, coaching, mentoring, Human Design services, AI-assisted tools, email communications, and related services (collectively, the “Services”).

CoachYou360 LLC (“CoachYou360,” “we,” “us,” or “our”) is a Virginia-based company operating in the United States. By accessing or using any part of the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not access or use the Services.

1. Eligibility and Acceptance

You must be at least 18 years old to use the Services unless explicitly stated otherwise. By using the Services, you represent that you have the legal capacity to enter into this agreement.

Your continued use of the Services constitutes acceptance of these Terms.

2. Scope of Services

CoachYou360 provides educational content and experiences, including but not limited to:

  • Digital products and downloadable materials

  • Web-based and mobile applications

  • Assessments and self-reflection tools

  • Coaching, mentoring, and Human Design–based services

  • Programs, workshops, and courses

  • AI-assisted insights and tools

All Services are provided for educational and informational purposes only and are non-clinical and non-therapeutic.

3. No Medical, Psychological, Legal, or Financial Advice

The Services do not provide medical, psychological, psychiatric, legal, or financial advice, diagnosis, or treatment. Any information, insights, or outputs are educational tools intended to support self-reflection and self-leadership.

You are solely responsible for how you interpret and apply any information provided. You should consult qualified professionals for advice specific to your situation.

4. Intellectual Property Rights

All content, materials, frameworks, systems, methodologies, language, prompts, designs, graphics, text, videos, audio, assessments, and tools made available through the Services are the exclusive property of CoachYou360 LLC and are protected by intellectual property laws.

Protected assets include, but are not limited to:

  • CoachYou360®

  • Testing Season™

  • Self-Leadership Analysis Engine™

  • All proprietary frameworks, archetypes, program structures, and original content

Nothing in these Terms grants you ownership of any intellectual property.

5. License to Use (Not Ownership)

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use only.

You may not:

  • Copy, reproduce, distribute, or share content

  • Resell, sublicense, or commercialize any materials

  • Create derivative works

  • Reverse engineer or attempt to extract system logic

  • Use content to train AI models or automated systems

  • Scrape, archive, or mass-download content

  • Remove copyright or trademark notices

Unauthorized use constitutes a material breach of these Terms.

6. AI-Assisted Features

Some Services may include content generated or enhanced with artificial intelligence (AI). AI-assisted outputs are provided for educational purposes only and may contain limitations or inaccuracies.

You acknowledge that:

  • AI outputs are not guarantees of accuracy or outcome

  • CoachYou360 is not responsible for decisions made based on AI-assisted content

  • You remain responsible for your interpretations and actions

7. Payments, Access, and Refund Policy

All sales of digital products, programs, courses, assessments, and app access are final.

No refunds will be issued for digital products or services once access has been granted, content has been delivered, or materials have been accessed, downloaded, or viewed.

CoachYou360 reserves the right to offer refunds at its sole discretion in exceptional circumstances, but no refunds are guaranteed.

8. Suspension and Termination of Access

We reserve the right, at our sole discretion, to suspend or terminate your access to the Services without notice if you:

  • Violate these Terms

  • Misuse, copy, or distribute proprietary content

  • Engage in abusive, harmful, or unlawful behavior

  • Attempt to exploit, scrape, or reverse engineer systems

  • Infringe on intellectual property rights

Termination does not entitle you to a refund.

9. User Conduct

You agree to use the Services lawfully and respectfully. You may not:

  • Interfere with system functionality

  • Attempt unauthorized access

  • Harass, threaten, or harm others

  • Upload malicious code or content

  • Misrepresent your identity or affiliation

10. Third-Party Services

The Services may integrate or link to third-party platforms (including hosting, email, analytics, scheduling, or payment providers). CoachYou360 is not responsible for third-party content, policies, or practices.

Your use of third-party services is subject to their respective terms and privacy policies.

11. International Users

CoachYou360 operates from the Commonwealth of Virginia, United States. If you access the Services from outside the U.S., you do so voluntarily and are responsible for compliance with local laws.

You acknowledge that your data may be processed and stored in the United States.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available.” CoachYou360 makes no warranties, express or implied, regarding accuracy, completeness, reliability, or suitability of the Services.

We do not guarantee outcomes, results, or uninterrupted access.

13. Limitation of Liability

To the maximum extent permitted by law, CoachYou360 LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to your use of the Services.

Your sole remedy for dissatisfaction is to discontinue use.

14. Indemnification

You agree to indemnify and hold harmless CoachYou360 LLC from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

15. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of such courts.

16. Modifications to Terms

We may update these Terms at any time. Changes will be effective upon posting with an updated effective date. Continued use of the Services constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
